Terms and Conditions

1. Validity

The terms and conditions set out below govern the sale and purchase of products form this website Your agreement with these terms and conditions is confirmed by the use of our website. Binnsberry Ltd reserves the right at any time to amend these terms and conditions, from which time the customer is bound by these modifications.

2. Contract with the customer

The contract between Binnsberry Ltd and the customer comes into affect when Binnsberry Ltd accepts payment for a customer's order. Please note Binnsberry Ltd are entitled to withdraw from contracts in the case of any obvious inaccuracies appearing on our website whether monetary or typographical.

4. Safety

We take safety issues very seriously. All toys are purchased from reputable importers/wholesalers and carry the CE safety mark. Other items, not classed as toys e.g. jewellery, hair bobbles, stationery do not carry this warning as they are not toys.


IN ADDITION, THE BAGS, WRAPPINGS, TIES, RAFFIA THEMSELVES ARE NOT TOYS AND MUST BE DISPOSED OF AS SOON AS POSSIBLE AFTER OPENING. We cannot accept any responsibility for a bag or it's contents getting into the hands of a child under 3, unless purchased from our designated area on the website.

We also give additional age limits on our website where appropriate (from manufacturers recommendations). If one of our party bags is suitable for example from 5+years, it will, in many cases mean that one of the items within the party bag is only suitable for children over this age. We cannot be held responsible for our party bags getting into the hands of a child below that age.

Please note, all our bags (except in the designated areas) are supplied with a warning note inside the bag detailing that the bag and it's contents are unsuitable for children under 3 years. The customer, nor any other person must remove this label from the bag. Many of our items within our bag have additional labels, providing warnings, safety information and instructions for use. These must not be removed. Any injury, damage or less occurring due to any of the labels being removed is not our responsibility.

Bags/gifts from our UNDER 3 section include a safety note detailing that "ADULT SUPERVISION IS REQUIRED AT ALL TIME" This must not be removed.

In addition, it is the responsibility of the customer to make sure that our bags are not given to any person that may have a specific condition which would render the bags unsuitable for them.

5. Allergies

Any sweets we provide with our party bags are pre-wrapped, most with ingredients detailed. When we provide chocolate with an order, we will include an ingredient list on our SAFETY NOTE so that any allergenic ingredients can be identified. We cannot guarantee that any of our chocolate is nut free and all contains soya and milk.

We can not be held responsible for any allergic reaction from a child eating our sweets or any other reaction e.g. choking. All our sweets (with the exception of chocolate varieties) are aimed at children of 3 years and above and we cannot be held responsible for sweets getting into the hands of children under 3 years.

5. Pricing

The prices of the goods are those specified on the Little Treasures website. There will be an extra charge for delivery (see point 6).

6. Delivery

We deliver to mainland England , Scotland and Wales . Please contact us for pricing information to other areas.

Orders received before 12 noon we aim to be dispatched that working day. Unless we await stock items

Orders received after 12 noon we aim to dispatched the following working day.

We offer 3 levels of delivery:

1. 2-3 days after dispatch; and

2. Next working day between 9.00a.m. to 5.30p.m. unless you choose our before 12 noon service.

3. Next day before 12 noon.

Please note, this is not a 100% guaranteed next working day delivery. On rare occasions things do go wrong due to reasons beyond our control e.g. breakdown of delivery van, forces of nature, incorrect/insufficient delivery information given at the time of ordering.

We cannot be held responsible for any delay in the delivery of your order. However, we will do our up most to remedy the situation and on the rare occasion where we are unable to meet party deadlines, a full refund will be given. Please note, if an attempted delivery has been made, no refund will be given if a party deadline is missed.

Delivery occurs at the point when the goods ordered by the customer have been left at the address specified. We cannot be held responsible for any damage occurring after this time.

The courier will attempt one delivery and then leave a card, then a further delivery then a card will be left for you to contact the depot. Please note this is a signed for service and we cannot guarantee a time. If you have not contacted the depot then the items will be returned to us and we will not be able to refund the postage or the return postage cost.

Please note that for Saturday parties, we recommend that Wednesday before 12 noon be the last ordering day.

You must contact us within 48 hours of delivery to advise of any shortfall or missing items otherwise we cannot be held responsible.

7. Substitution

In the event that one of our items is out of stock, we will endeavour to contact you as soon as possible by e-mail or telephone to offer a substitution. At this point you may ask for a full refund. If we are unable to contact you and the order is for a next day delivery - please ensure you supply a mobile or day time contact telephone number, we will proceed with the order using the most appropriate substitution possible.

8. Little Treasures Warranty

If the delivered goods are not as those requested, the wrong quantity, or damaged in any way, Little Treasures will either give a full refund or make good any shortfall in the order or replace any damaged goods. We must be notified of any damage/shortfalls within 24 hours of delivery acceptance.

If the customer's choice is to return all the goods back to ourselves, we will arrange a courier to collect the goods.

If we are not notified of any damage/inaccuracies within the 24 hour period, we will believe your order to be in full satisfactory state and no refunds will be given.

9. Return of Goods

If, in the unlikely event that the customer is not entirely happy with their purchase, they can ask for a full refund. Please contact us within 24 hours of receipt of your delivery on 01606 77900. Returning items is the responsibility of the purchaser and once the goods are received back to us, we will issue a refund, less any postage and packing costs. Please note we issue refunds as soon as possible. Credit cards may take up to 30 days via the credit card clearing system, which is beyond our control. Returned goods must be received within 7 days of it's original receipt by the customer and they must be received in a resaleable condition with all component parts. Binnsberry Ltd requests that you use registered post or recorded delivery when returning goods and that proof of postage is retained. The cost of the postage is covered by the consumer.

No refund is available for personalised chocolate bars

10. Intellectual Property

All of the website design, information, data, text, graphics, logos are the property of Binnsberry Ltd. Unauthorised use of the material or republication without the prior written consent of Binnsberry Ltd is prohibited.

11. Governing Law

These terms and conditions and any contract arising between the customer and Binnsberry Ltd are governed by English Law.

12. Discounts & Pricing

We reserve the right at any time to change our pricing and discount items.

13. Privacy Policy

Any information you provide us so that we can fulfill your order is treated as confidential. From time to time we may send out mailings - newsletters or promotions. If you do not wish to receive any of these mailings, please contact us.

14. General Liability

We are not liable for any loss of profit, loss of business or any other consequential, special or indirect losses, costs, expenses or other claims for compensation, whether caused by our negligence or not, in connection to the products offered for sale on this website or their use or the manner in which we have delivered our services. We are not liable to pay you any compensation other than a refund equal to the price of the products that you have paid for.

15. Links

Binnsberry Limited accepts no liability for any of the links or other businesses contained within our website. They have purely been recommended to us by customers.

16. Distance Selling laws

If you are contracting with us as a consumer online or by phone, you have the right to cancel your contract at any time up to 7 working days after the day on which you receive the goods you ordered. If you have paid a delivery charge this will also be refunded but if you are only returning part of the order, then we are not obliged to repay any of the delivery charge. You must take reasonable care of the goods whilst in your possession and they must be returned to us.

You must inform us of the cancellation of the contract.

This is not intended to be a full statement of all your rights under the Distance Selling Regulations. Full details of your rights under the Distance Selling Regulations are available from your Local Citizens’ Advice Bureau or your Local Authority’s Trading Standards Office.

The Regulations do not apply to orders placed in store.
